Hi viewers.
This is a post to help creators that would like to gain
more insight with the safe balance between
supporting the creator(s) content they enjoy much or
simply sharing their appreciation while trying to stir clear
of a copyright issue(s).
With the help of Microsoft's Copilot and other source material,
I will do what I can to provide information that may
point creator(s) & supporter(s) in the right direction to do that.
Do not hold me to this information as the definitive
and only way of enjoying everything about creator content
as well as providing support.
Whatever you choose to do is your choice overall.
There was a point, when I was like any other big fan
of other creator(s) creative content during the time
art became a part of my life. Some years ago,
businesses started cracking down on the use of
copyrighted content being used as fan-art
and illegal means of self-promotions as
well as the wrong use of crediting content
under the fair-use law(s).
At that point in life, I got really bummed out
and frustrated with not wanting to get into
legal issues with creator(s) and business
due to wanting to share creative content
solely for the appreciative enjoyment with others
who were doing the same thing or had the same
intentions with sharing online.
That is one big reason I am sharing this topic
with creator(s) because I know what it feels like
to be a fan and not simply create for the sake of
enjoying something that is not my own and
not having the personal skills to achieve the
same/similar quality as those that inspired or influenced
me during my growth over the years.
IMPORTANT NOTE(S):
- All content shared that is not my own is credited to those who own that content fully.
- Example choices were only chosen to give better/clearer representation for the information shared, viewers can visualize rather than read a bunch of text based on the subject matter presented.
- If any of the property/rights to the content shared that is not my own is requested for removal, I will make an effort to remove that content as soon as possible and leave what information I can to support those who can use it freely.
- If you are able to support the original creator's content, please make an effort to learn how to do that or seek the business that has license rights to connect with the content you are interested in. If you are not able to use either of those options, at least seek giving credit information with whatever content you create in relations/regarding your chosen original creator(s) when sharing.
- Among the information shared, there may be some special cases. Someone could be an employee working for a business and create conceptual art that does not get used for any production that they have permission to share.
The content shared from a business position may still be copyright material, except that company decides how it is shared without legal issues arising. I do believe employees can still get into work related trouble for sharing production material without them knowing and finding out.
There may be an official business logo/tag used with that shared content, or someone does have collaborative permission to reveal too. If neither collaborative nor business permission is a part of sharing content, it is possible that the sharer gained permission without connection to the source material.
- If you have questions or would like to add to the subject that I may have forgot to mention, these posts usually have a comment section to do that I believe.
- When I finished this post and tried to submit, Blogger gave me a community guideline message that caused this post to be hidden. I skimmed over their information; except they did not give any indicators beyond the message to help me remove anything that is not allowed.
Therefore, all the provided links I had added for content shared were removed.
I am not sure of what the post had wrong with it,
so that is why no links are provided for content that is not mine.
Thank you for your understanding and hopefully
this post will help creator(s) be safer as well as
enjoy what they like from other inspiring creator(s) more freely.
FAN-ART OVERVIEW
Fan-Art (Cambridge Definition):
- drawings, paintings, etc. based on a TV show, movie, book, game, etc. or the characters in it, created by fans (= people who admire or are very interested in something).
Fan-Art Options to Avoid Copyright Issues When Sharing Content Inspired by Other Creator(s) Works:
|
This is the question I asked Copilot and reply I received. - Ycrem0 |
Type(s) Of Fan-Art (Examples - Not Full Range of Types)
|
Naoko Takeuchi-dono's Original Sailor Moon Manga Art Cover |
|
TalesOfPinkAnime's Sailor Moon Fan-Art |
TalesOfPinkAnime's fan-art of Naoko Takeuchi-dono's character Sailor Moon
would be considered an example of copyright infringement as the
representation of the original character is identical or strikingly
similar to the original character design.
If this fan-art had intentions of being sold, reproduced for alternative profits,
claimed for credit, or used as promotional material without permission
from original creator or the license holding company to the content
of Sailor Moon would put them in violation of copyright issues.
|
Sailor-Serenity's Sailor Moon Inspired Original Character Design Sheet |
Sailor-Serenity's character design is inspired by Naoki Takeuchi-dono's
original designs for her creation Sailor Moon. This is potentially
the safe way a creator(s) can showcase their liking
of other creator(s) works, have fun creating
their character ideas based on content they like,
and avoid reproducing
another creator(s) works illegally or without permission.
If Sailor-Serenity had means of reproducing her
inspired character design for profit, promotional
content, personal uses, or claim property rights,
I would believe that she would be able to without
any legal issues from the inspired content
creator(s) or businesses that have license
rights of that content too.

Masashi Kishimoto-dono's Original Naruto Akatsuki Shonen Jump Page Spread
|
|
osy057's Original Character Design Group Inspired by Masashi Kishimoto-dono's Akatsuki Organization |
osy057's created his own organization of criminal ninja characters
as well as other Naruto inspired designs that shares
his liking and appreciation for what Masashi Kishimoto-dono's
original creation(s) that has influenced him greatly.
He also had his own Naruto inspired project called Naruto Eledia
going on some years ago, except that did
not go fully as planned with schooling
and life situations from what I can remember.
osy057 was one of the creators I found with content
that I like during the early years of being into the
developing ninja manga universe of Naruto.
Whatever happened to osy057, hoping he
is doing too well to have time to update
his profile or praying all is well
with whatever has come his way in life.
Additional Example to Support The
Reason This Post Is Relevant for Creator(s):
Recently this year, an anime studio I saw on YouTube
called Studio ECLYPSE had a fan-animation trailer
called Berserk: The Black Swordsman that is
inspired by Kentaro Miura-dono's Berserk manga.
In Studio ECLYPSE's words,
"Studio ECLYPSE is a collective of fans from all over the world,
we make high quality fan-animations for the community to enjoy for free."
The fan-animation they produced for
Berserk: The Black Swordsman
is definitely high-quality and their goal
to create content that similar fans can enjoy
freely is an awesome collaborative goal.
Unfortunately, they missed a very important step
in the process of being fans of content they
did not own, have rights to reproduce, and
permission was not granted to share the
highly inspired project, even if production
was a tribute to the original creator.
My point for sharing this news is
that these very creative and skilled individuals
put a bunch of work into a project that included
or was entirely based on another creator's work,
which got them hit with copyright infringement claim
from Berserk's official licensed production team
Studio Gaga for not getting permission
to do what they were doing.
I am not stating that their efforts were in vain
or wasted, except imagine if Studio ECLYPSE
gained Studio Gaga's approval to allow a
group of skilled fans to share a project
based on the Berserk's universe. That
would have been a momentous opportunity
and honor of fan's achievements as well as
the company I would believe.
Even if Studio ECLYPSE did not gain permission
to create and share a Berserk-based fan-animation
project, I believe they still could have used
all of their efforts to create their own universe
inspired by the creator they chose to give tribute
to without hitting that fundamental copyright
infringement pitfall.
Since I found their studio recently this year,
I would have greatly like to have known
what kind of animated content they could have
produced as a project with a large amount of
the content being inspired only by Berserk's universe.
The moral lesson of this story is
to seek permission for content that is
used regarding other creator(s) works
you would like to use, before investing in
a project with that content as the source material.
If you are unable to get permission granted
for set material, do not be discouraged and
put effort into creating your own inspired
content based on the things you enjoy
and possibly no one can tell you differently
how to use that content or at least
certain laws to prevent will not involve you.
Happy creating and creator(s) supporting viewers.
